What is a recess appointment?
A recess appointment lets the president temporarily fill a vacancy while the Senate is in recess. It does not require Senate confirmation before the person takes office.

How long does a recess appointment last?
Under Article II, Section 2, Clause 3, the president may fill vacancies that happen during the recess of the Senate. The president grants commissions that expire at the end of the Senate’s next session.
The deadline is the end of the next session, not the day the Senate returns from recess. A recess appointment does not grant an unlimited term or replace the regular confirmation process.
Does every Senate break allow a recess appointment?
No. In NLRB v. Noel Canning, the Supreme Court set limits on short recesses. A recess of more than three but fewer than ten days is generally too short. The Court left room for unusual emergencies. The power covers recesses within a session and between sessions, including vacancies that already existed before the recess.
The Senate can also hold brief pro forma sessions. These count as sessions if the Senate retains the capacity to conduct business under its rules. Cornell’s recess appointments overview explains these limits.
How does this differ from advice and consent?
In the regular process, the president nominates someone and the Senate decides whether to confirm that nominee. A recess appointment temporarily fills the vacancy without that confirmation. The advice and consent guide explains the Senate’s constitutional role.
